Temporary Contract of Employment
This Temporary Contract of Employment (“Agreement”) is made between TD Recruitment Limited, Channel Court, 8 Hill Road, Clevedon, Avon, BS21 7NE (“the Agency”) and you (“the Worker”).
1. Status and Appointment
The Agency engages the Worker on a temporary basis to carry out assignments for the Agency’s clients. Engagement may be on PAYE, CIS or Umbrella company engagement, as agreed prior to each assignment. The Worker’s status and method of engagement will be confirmed before the start of each assignment. Nothing in this Agreement guarantees continuous work or a minimum number of hours.
2. Duration of Engagement
This Agreement takes effect from the start date of the Worker’s first assignment and will continue on a temporary, ongoing basis unless terminated in accordance with this Agreement. Each assignment may vary in length depending on client requirements.
3. Place of Work
The Worker will be required to work at locations specified by the Agency and/or its clients. Full assignment details, including site address and contact information, will be provided prior to commencement.
4. Hours of Work
Working hours will vary depending on the client’s requirements and will be confirmed prior to each assignment. The Worker may be asked to work overtime, subject to the Working Time Regulations 1998 and any applicable opt-out agreement.
5. Pay and Holiday Pay
Pay rates will be agreed before the start of each assignment and confirmed in writing. Payment is made weekly. The first week of work is paid one week in arrears. Payment is made according to the agreed engagement method (PAYE, CIS, or Umbrella). Holiday pay is paid in accordance with statutory requirements and is paid weekly as part of the Worker’s pay. Holiday pay is not accrued, banked, or held in a separate “holiday pot” by the Agency. It is included within the Worker’s weekly pay unless otherwise stated in writing. It is the Worker’s responsibility to ensure that they take adequate rest and holiday during periods when they are not on assignment.
6. Sickness and Statutory Sick Pay
Where applicable and subject to eligibility, PAYE workers may be entitled to Statutory Sick Pay (SSP) in line with current legislation. CIS and Umbrella workers are not normally entitled to SSP from the Agency. In the event of sickness or injury, the Worker must notify their line manager on the first day of absence; arrange for a relative or friend to notify the Agency if unable to do so personally; provide a doctor’s fit note for absences exceeding 7 consecutive days; and complete any required absence documentation upon return. Failure to follow this procedure may affect entitlement to SSP where applicable.
7. Termination
This Agreement may be terminated by either party by giving 7 days’ notice. The Agency reserves the right to terminate this Agreement immediately without notice in cases of gross misconduct, serious breach of this Agreement, or conduct likely to bring the Agency or its clients into disrepute. Assignments may also end without notice where a client assignment comes to an end.
8. Confidentiality
The Worker must not, during or after their engagement, disclose or misuse any confidential information relating to the Agency or its clients, except where required in the proper performance of their duties or by law.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
10. Entire Agreement
This Agreement, together with the Temporary Agency Workers Handbook and associated policies, constitutes the entire agreement between the parties and supersedes all previous agreements or understandings.
11. Policies and Procedures
The Worker acknowledges that they are subject to the Agency’s policies and procedures as amended from time to time. A full policy pack is available and may be issued to the Worker upon request or provided electronically. This includes, but is not limited to, Agency Workers Regulations (AWR), Health & Safety, Equality Diversity & Inclusion, Bullying & Harassment, Data Protection (UK GDPR), Modern Slavery & Human Trafficking, Right to Work Compliance and Whistleblowing. The current Policy Pack (updated January 2026) forms a supplemental document to this Agreement but does not form part of the Worker’s contractual terms unless expressly stated.
